Oceana's World Online Business Law: Topical Chapters

Contributors are needed to prepare chapters covering the special topics listed below, where indicated. The Editors invite proposals from prospective authors for other topics to be covered as well.

Unlike the country and regional chapters, which address the online business laws of particular legal jurisdictions, the multilateral (topical) chapters are not intended to cover the laws of a specific country (this is done in the country chapters), nor to provide a comprehensive survey of every country's law on the subject. Instead, the topical chapters are intended to deal with the particular topic at a greater level of generality than is possible in the country commentaries. For example, some of the topical chapters focus on mulitlateral business or technical issues, and would thus not have been suitable for, nor covered in, a country-based legal chapter. As another example, other topical chapters covering international or transnational legal issues can deal with issues at a more theoretical level than the country commentaries, which are more focused on explaining what a given country actually does on a particular subject. The multilateral chapters can also discuss the international material (eg ICANN, WIPO) that is not country-specific and that would not have been covered in a country commentary.

We welcome suggestions and proposals from potential contributors interested in preparing a special topic chapter, either one of the ones listed below or others to be proposed by the author. The author will have wide latitude to use his discretion to determine the proper layout, lenght, and scope and style of treatment of a given topic. Please email or otherwise contact me or Andrew Simpson if you are interested in preparing a topical chapter.

  • Information Security/ Digital Signatures/ Electronic Record-Keeping (contributor needed)
  • Digital Signatures (need author to supplement and summarize the ABA's Digital Signature Guidelines)
  • Cryptography (contributor needed)
  • The Domain Name System (contributor needed)
  • Payment Mechanisms (contributor needed)
  • Trans-border Data Flow (contributor needed)
  • Introduction to Internet Technologies (contributor needed) (this chapter will cover: Packet-switching; Transmission systems; Basic network components and architecture; Firewalls; Cache systems; Filtering systems; etc.)

  • Overview of ABA's Digital Signature Guidelines (contributor needed) (author needed to summarize and explain the ABA's Digital Signature Guidelines and supplement with additional commentary and information)
  • Getting Online: Contracting for Provision of Services (contributor needed--possible: George Thompson, Neville Peterson)
  • Determining Jurisdiction (contributor needed--possible: George Thompson, Neville Peterson)
  • Jurisdictional Issues in International E-Commerce Contracts (possible: Norel Rosner, Assistant Professor, Department of Private and Notary Law, University of Groningen)
  • Taxation (contributor needed)
  • "International Business Transactions"/transnational law-related topics, with reference to online transactions and business, such as:
    • International arbitration/transnational contract enforcement
    • Enforcement of foreign judgments
    • Other IBT-type topics that are international in character, e.g. governed by international treaties/regimes, particularly those that would not be covered covered in detail in any given country chapter.
